1. Agreement to Terms

By accessing or using MomentDrop ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

The Service is operated by Systaro GmbH ("we", "us", "our"), registered in Austria, European Union.

2. Description of Service

MomentDrop is a photo and video sharing platform designed for events. Users can:

• Create events and generate shareable QR codes
• Upload photos and videos to event galleries
• View and download shared content
• Customize event appearance and settings

3. Account Registration

To create events, you must register for an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You must be at least 16 years old to create an account.

4. Acceptable Use

You agree not to use MomentDrop to:

• Upload illegal, harmful, or offensive content
• Share content that violates others' privacy or rights
• Upload content you don't have permission to share
• Harass, abuse, or harm other users
• Distribute malware or spam
• Attempt to access other users' accounts
• Use the service for commercial advertising without permission

We reserve the right to remove content and suspend accounts that violate these guidelines.

5. Content Ownership

You retain all ownership rights to content you upload. We do not claim any ownership over your photos or videos.

By uploading content, you represent that:

• You own or have the right to share the content
• The content does not infringe on others' rights
• You have consent from people appearing in photos (where required by law)

6. Event Organizer Responsibilities

If you create an event, you are responsible for:

• Informing participants that photos will be shared
• Moderating content uploaded to your event
• Respecting participants' requests to remove their photos
• Complying with applicable privacy laws (including GDPR)

7. Subscriptions & Payments

Free Tier

The free tier includes limited features as described on our pricing page. No payment is required.

Paid Subscriptions

• Subscriptions are billed annually
• Payments are processed securely via Stripe
• Prices are in Euros (€) and include applicable VAT
• Subscriptions auto-renew unless cancelled

Refunds

We offer a 30-day money-back guarantee. If you're unsatisfied, contact us within 30 days of purchase for a full refund.

Cancellation

You may cancel your subscription at any time. You'll retain access until the end of your billing period.

8. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

9. Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. We may:

• Perform maintenance with reasonable notice
• Modify or discontinue features
• Suspend service for security reasons

We are not liable for any loss or damage resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the past 12 months

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms.

Upon termination:

• Your right to use the Service ceases immediately
• You may download your content within 30 days
• We may delete your data after 30 days

13. Governing Law

These Terms are governed by the laws of Austria. Any disputes shall be resolved in the courts of Vienna, Austria.

For EU consumers: You may also use the EU Online Dispute Resolution platform at ec.europa.eu/odr.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
